On one beautiful spring day in May 1999, I was doing what
I love: horseback riding. Unfortunately, a good ride was about to be spoiled.
In the flash of an eye, I knew I had only two choices: get off 1,000 pounds
of an out-of-control horse or go down with her. I jumped, tucked, and
rolled - upwards of 35 mph - and smashed backwards into a barn wall. The
horse was fine. My ribs, two vertebrae, and my tailbone were not.
My successful career in outside sales came to the same sort
of sudden halt I did. When (due to pain) you can't lift sales material
and walk into a customer's office, suddenly you become very interested
in your health care and disability policies. I qualified for and received
short-term and then long-term disability and underwent a year and a half
of intense physical therapy. Once I started feeling better, I wanted to
go back to work, unknowingly forfeiting my "permanently disabled"
status.
The following years were a continuation of multiple frustrations.
I experienced great physical pain, incorrect diagnoses, then eventually
found the right physicians and had a double spine fusion and a double
diskectomy. However, my health issues were just part of the problem.
I was denied long-term disability due to the disability
insurance carrier classifying my injury as a pre-existing condition. Deciding
to appeal and challenge the decision of the disability insurance carrier,
left me to contend with constant red tape and bureaucratic stonewalling
from the insurance company.
At the same time, the company I worked for was sold and
all health care benefits were cancelled - including continuation of health
insurance, which is not in compliance with COBRA.
After many hours on the Internet and in the library, I was
acutely aware there were a tremendous number of questions to which I could
not find answers. Every attorney I consulted with said there was nothing
that could be done.
Realizing I had to be my own best advocate, I started an
intensive research effort to find out how I could protect my rights related
to health care and disability benefits,through my extensive research and
new found knowledge,I was able to regain almost all of my benefits.
